Internal Regulations
1. Preambule
ANEO is a professional training organization. Its registered office is located at 122 avenue du Général Leclerc, 92100 BOULOGNE-BILLANCOURT. It is registered under activity declaration number 11 92 16843 92, with the prefect of the Ile-de-France region. This internal regulation aims to specify certain provisions applicable to all registrants and participants in various training activities organized by ANEO, both in-person and remotely, in order to ensure the smooth operation of the offered training.
Definitions:
- ANEO will be referred to as the 'training organization';
- Individuals attending the training will be referred to as 'trainees';
- Individuals conducting the training will be referred to as 'instructors'.
2.General provisions
Article 1 - Purpose of the Regulation
Pursuant to the provisions of Article L.6352-3 of the Labor Code and under its general and collective regulatory authority, the management of the training organization establishes the following:
- Measures for implementing regulations regarding hygiene and safety,
- General and permanent rules regarding discipline. It also determines, in accordance with the principles defined in Article L.6352-4 of the Labor Code, the nature and scale of sanctions that may be applied in the event of a breach of the aforementioned rules and sets forth provisions regarding the rights of defense that must accompany the implementation of such sanctions.
Article 2 - Persons Concerned
The rules derived from this internal regulation apply:
- to all trainees in each training and for the entire duration of the training attended. Each trainee is considered to have accepted the terms of this regulation when attending a training provided by the training organization and agrees that measures may be taken against them in case of non-compliance.
- to each instructor.
3. Hygiene and Safety
Article 3 - General Rules
Each trainee must ensure their personal safety and that of others by following the general and specific safety and hygiene instructions in force at the training location. In accordance with Article R.6352-1 of the Labor Code, it is emphasized that when the training takes place in an establishment already equipped with internal regulations, the applicable safety and hygiene measures are those of the internal regulations of that establishment. When the training takes place in the premises of the training organization or in external premises without internal regulations, all provisions of this "Hygiene and Safety" chapter will be applied. The management of the training organization assumes responsibility for hygiene and safety within its establishment. It is responsible for implementing and ensuring compliance with all legislative and regulatory provisions imposed on it due to the characteristics of its activity and organization. General provisions are detailed in the following paragraphs.
Special or occasional measures may be implemented through internal notes, as indicated below when the specificities of the situation, activity, or organization of the training require it.
Article 4 - Compliance with Hygiene and Safety Measures
It is the responsibility of the instructor to supervise the trainees and to provide information on safety related to the stages they conduct, as often as necessary, and to monitor compliance with these instructions. Every trainee has the duty to immediately report to the instructor or the management of the training organization any urgent measures to be implemented to stop any danger. Every instructor has the duty to refuse on the training site any person not adhering to safety instructions and refusing to comply after notification by the instructor.
Article 5 - Protection and Safety Devices
Hygiene and safety measures, as well as the occupational health prescriptions resulting from current regulations, are mandatory for everyone. To this end, the general and specific safety instructions applicable in the training organization must be strictly followed.
Trainees must:
- Use the individual protective devices provided to them, ensure their conservation and maintenance,
- Adhere to the safety instructions specific to each training or location,
- Immediately report to the instructor or the management of the training organization any malfunction or deterioration of hygiene and safety devices,
- Immediately report to the instructor or the management of the training organization any stoppage or incident of equipment or installations of any kind, any failure that may compromise safety
Article 6 - Washbasins/Toilets
Each trainee or instructor is required to leave the washbasins, toilets, and any other sanitary facilities provided to them in a clean and tidy condition.
Article 7 – Repas/boissons
It is forbidden to enter or stay in the establishment in a state of intoxication and to introduce alcoholic beverages. Trainees are prohibited from having their meals in the premises assigned to the training unless expressly authorized by the management of the training organization.
Article 8 - No Smoking
Smoking is strictly prohibited inside all premises of the establishment designated for collective use. Premises for collective use include not only those permanently occupied by at least two people but also any premises where individuals other than the usual occupant may enter, whether they are trainees, company trainees, or external individuals. A sign reminding of the smoking ban is displayed in the designated areas. Failure to comply with the smoking ban in these premises will result in disciplinary action.
Article 9 - Firefighting Devices
In accordance with articles R. 232-12-17 and following of the Labor Code, fire instructions, including a location plan for fire extinguishers and emergency exits, are displayed in the training premises in a way that is known to all trainees. Instructors and trainees must familiarize themselves with the fire safety instructions and adhere to them. They must ensure free access to firefighting equipment and materials, as well as emergency exits.
Article 10 - Accidents and Health Issues
Any accident or incident, even seemingly minor, that occurs to a trainee during the course or training must be immediately reported to the management of the training organization, either by the person involved or by any other person who becomes aware of it. In accordance with Article R. 962-1 of the Labor Code, an accident that occurs to a trainee while on the training premises or while going to or returning from it must be reported by the person in charge of the organization to the Social Security Fund. It is in the interest of trainees to inform the management of any health problems (back pain, respiratory problems, physical disabilities, etc.) or need for accommodation to allow, if necessary, an adjustment of the proposed exercises. When the training is conducted remotely, the training organization cannot be held responsible for incidents or accidents that may occur during this training and/or during the use of the Internet and/or computer tools by the participants.
4. Disciplinary Rules
Article 11 - Attire and Behavior
Trainees and instructors are requested to present themselves at the training location in decent attire and to behave appropriately towards everyone in the organization. The values upheld by the training organization and the tradition of quality in internal relations justify that everyone strives to demonstrate courtesy, respect for others, open-mindedness, discretion, and politeness in all circumstances. The rules of individual general behavior and the smooth running of the training organization therefore formally prohibit:
- Displaying inappropriate behavior towards other trainees or instructors,
- Spending training time on activities unrelated to the training,
- Keeping files or documents at home without express written authorization from the management of the training organization,
- Circulating lists of subscriptions, collections, lotteries, petitions, or political or non-political affiliations,
- Organizing unauthorized collections,
- Engaging in any trade,
- Taking objects belonging to the training organization without express written permission from the instructor,
- Being in a state of intoxication or under the influence of drugs.
Article 12 - Schedule
The training schedules are set by the training organization and communicated to the trainees either through the electronic invitation or upon delivery of the training program. Trainees and instructors are required to adhere to these schedules. The training organization reserves the right, within the limits imposed by current regulations, to modify the training schedules based on service requirements. Trainees and instructors must comply with any modifications made by the training organization to the organization's training schedules. Except in exceptional circumstances, trainees are not allowed to be absent during training hours.
In case of absence or lateness, the trainee is requested to inform either the instructor, the management, or the secretariat of the training organization. The training schedules must be strictly adhered to, under the penalty of disciplinary sanctions. Latecomers should notify the training organization of any delay, if possible, in advance. Depending on the operating conditions of the training, the latecomer may be required to resume the training only at the time indicated by the instructor. Furthermore, trainees are required to complete and sign the attendance certificate regularly as the training progresses. In the case of distance training through video conferencing, trainees must log in between the start and end dates and times of the training indicated in the training agreement or communicated by any other means by the training organization.
Article 13 – Accès au lieu de formation
Sauf autorisation expresse de l’organisme de formation, les stagiaires et formateurs ayant accès au lieu de formation pour suivre ou dispenser un stage ne peuvent :
- y entrer ou y demeurer à d’autres fins,
- faciliter l’introduction de tierces personnes à l’organisme.
Article 14 – Entrées et sorties
Les entrées et les sorties des stagiaires et formateurs s’effectuent en empruntant les itinéraires et issues prévus à cet effet. Il est interdit de pénétrer dans les locaux ou d’en sortir par toute autre issue. Les stagiaires n’ont accès aux locaux de l’organisme de formation que dans le cadre de l’exécution de leur stage : ils n’ont aucun droit d’entrer ou de se maintenir sur les lieux du stage pour une autre cause sauf s’ils peuvent se prévaloir d’une autorisation écrite par la Direction de l’organisme de formation.
Les sorties pendant les heures de stage doivent être exceptionnelles ; elles sont subordonnées à une autorisation expresse du formateur pour les stagiaires.
Article 15 - Equipment and Documents
Each trainee and instructor is obligated to keep in good condition the equipment and documents entrusted to them. They must not use them for other purposes, especially personal use, except for the equipment provided for that purpose. At the end of the training or employment contract, the trainee and the instructor are required to return all equipment and documents in their possession that belong to the training organization.
Access to the computer provided during the training The use of the computer is expressly and nominatively granted by the direction of the company, within the premises of the training organization. Rules for using the computer station The use of the computer is strictly limited to its pedagogical use by the trainee within the framework of the training provided by the training organization. Except with the express agreement of the company or in case of force majeure, the beneficiary cannot use the computer for personal purposes. The computer should not be used on days when training does not normally take place without the agreement of the company's management. Responsibility related to computer equipment The beneficiary is solely responsible for the use of their computer. Any material damage incurs the user's liability. Any violation of these rules could result in disciplinary action. Commitment regarding computer use Do not install software without a valid license in the name of the company Aneo and, in general, do not install video games, store protected multimedia files, illegal or dangerous computer programs for system security. Do not store personal or confidential items on the computer. Do not consult or disseminate internet or other documents that are racist, pornographic, pedophilic, defamatory, or generally disseminate or consult information that constitutes a crime. Keep the computer permanently in a secure location (the assigned training room) and never leave it unattended if the room remains open. Inform the company immediately in case of malfunction, theft, or damage. Return the device in the same condition it was entrusted, upon simple request from the company. Allow the training organization to update the antivirus, firewall, and regularly perform verification scans, and leave remote access enabled. The organization will repair or replace the device in case of malfunction.
Article 16 – Phone and other external communications
Unless expressly authorized by the trainer or the management of the training organization, the use of the phone for private purposes is prohibited. Trainees are not authorized to have personal correspondence or packages sent to the address of the training organization.
Article 17 – Intellectual Property and Data
It is strictly forbidden to record, photograph, or film training sessions, filmed materials, or others. The educational documentation provided during training sessions is protected under copyright law and cannot be reused other than for a strict use related to the training.
Article 18 – Responsibilities of the organization in case of theft or damage to personal belongings of trainees
ANEO disclaims all responsibility in case of loss, theft, or deterioration of personal items of any kind deposited by trainees or trainers in the premises of the training organization.
Article 19 – Sanctions
Any breach of the trainee of any provision of this Internal Regulations may result in a sanction, whether this breach is observed in the context of face-to-face training or distance learning. In accordance with Article R.6352-3 of the Labor Code, a sanction constitutes any measure other than verbal warnings, taken by the Director of the training organization or his representative following an act by a trainee considered by him as faulty, whether this measure immediately affects the presence of the person concerned in the training or calls into question the continuity of the training received by the trainee.
Article 19.1 – Nature of sanctions
Depending on the severity of the observed breach, the sanction may consist of:
either a warning or a measure of temporary or definitive exclusion
Fines or other financial penalties are prohibited. The person in charge of the training organization must inform of the sanction imposed:
the employer of the trainee (only when the training is carried out at the request of the employer) the stage financier
Article 19.2 – Scale of sanctions
The sanctions defined in the previous article are listed in ascending order of severity. The choice of the sanction in the scale thus defined will depend on the seriousness of the fault. However, the decision to be made in each case will be determined by taking into account all personal and material factors that are likely to mitigate or aggravate the applicable sanction.
Article 19.3 – Procedure applicable to sanctions Article
19.3.1 – Procedure applicable in case of definitive exclusion from the training
In accordance with the provisions of Article R.6352-4 of the Labor Code, it is recalled that the trainee will be informed of the grievances against him before any notification of a warning. Simple written warnings are notified to the trainee concerned specifying the grievances against him. This notification is made:
Either by hand-delivered letter against signature of a copy, Or by registered letter with acknowledgment of receipt or not.
Article 19.3.2 – Disciplinary procedure
No sanction can be imposed on the trainee without prior information of the grievances against him. The disciplinary procedure applies both in the case of face-to-face training and in the case of distance learning. When the person in charge of the training organization or his representative plans to take a sanction that has an immediate or delayed impact on the presence of a trainee in training, the following procedure is followed:
The Director or his representative summons the trainee indicating the purpose of this summons. It specifies the date, time, and place of the interview. It is written and is sent by registered letter or delivered to the interested party against a receipt. During the interview, the trainee may be assisted by the person of his choice, in particular, the stage delegate if he exists, a trainee of the training organization. The Director or his representative indicates the reason for the envisaged sanction and collects the explanations of the trainee. In accordance with the provisions of Article R.6352-6 of the Labor Code, the sanction cannot then occur less than one full day or more than fifteen days after the interview. It is the subject of a written and motivated decision, notified to the trainee by registered letter or delivered against receipt. When the act has made necessary a provisional measure of temporary exclusion with immediate effect, no definitive sanction, relating to this act, can be taken without the procedure provided for in Article R.6352-4 of the Labor Code and, if necessary, in Articles R.6352-5 and R.6352-6 of the Labor Code, having been observed.
Article 19.3.3 – Conservatory suspension
When the trainee's action makes it essential a provisional measure of suspension with immediate effect, this measure will be notified to him verbally at the time when it will be imposed. The trainee must comply with it immediately.
5.Information and posting
The circulation of information is done through posting on the boards provided for this purpose. Each trainee and trainer has read this internal regulation. A copy of this Internal Regulations is available in the premises of the training organization. A copy of this regulation will also be given to the trainee as part of a professional training contract.
